The purpose of The Protection of Personal Information Act (2013), otherwise known as POPIA, is to establish a code of conduct for the confidential handling of Personal and Special Personal Information.

Responsible parties who are non-compliant to the act may face a fine of up to R10 million or imprisonment.

What is Personal Information?
Definition:
‘‘Personal information’’ means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing, juristic person, including, but not limited to (known as a “data subject”).
In short, personal information is any information that can identify you as a person or your company. POPIA aims to protect the processing and flow of Personal Information across companies and across the borders of South Africa.
